29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) On or about October 11, 2024, at the worksite, 409 Washington Avenue, Oneida, NY 13421: The employer failed to provide abatement certification for citation 1-1 identified in the inspection of this workplace. An abatement demand letter was sent to the employer on April 2, 2025.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems:  a) On or about October 11, 2024, at the worksite, 409 Washington Avenue, Oneida, NY 13421: The employer failed to ensure employees engaged in residential roofing activities were protected from falling by use of guardrails, safety net systems, or personal fall arrest systems.  Employees were exposed to fall hazards as high as 20 feet.  Marcello Japon, doing business as New Pro Home Renovations, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1631365, citation number 1, item number 1 and was affirmed as a final order on May 8, 2023, with respect to a workplace located at 827 Burnet Avenue. Syracuse, NY 13203.  Marcello Japon, doing business as New Pro Home Renovations, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1693385, citation number 1, item number 1 and was affirmed as a final order on April 5, 2024, with respect to a workplace located at 4504 W. Seneca Turnpike, Syracuse, NY 13215.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about October 11, 2024, at the worksite, 409 Washington Avenue, Oneida, NY 13421: Employer failed to ensure a portable extension ladder an employee used to access a roof had the side rails extended 3 feet above the access point.  The employees was exposed to an 11 foot fall hazard.  Marcello Japon, doing business as New Pro Home Renovations, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1631365, citation number 1, item number 2  and was affirmed as a final order on May 8, 2023, with respect to a workplace located at 827 Burnet Avenue. Syracuse, NY 13203.
