29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) At 21985 Aleution Avenue, Lot 63 Roberts Cove, Foley, Alabama: On October 15, 2024; the employer allowed his employees to perform roofing activities without fall protection exposing his employees to a fall hazard of 10 feet 3 inches to the ground below. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At 21985 Aleution Avenue, Lot 63 Roberts Cove, Foley, Alabama: On February 8, 2024; the employer allowed his employees to use an extension ladder to gain access to the roof and the rails of the ladder did not extend at least three feet above the roof landing to provide safe access exposing his employees to a fall hazard of 10 feet 3 inches to the ground below. The Alberto Garcia dba Alberto Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(B)(1), which was contained in OSHA inspection number 1558742, citation number 1, item number 2, and was affirmed as a final order on February 24, 2022, with respect to a workplace located at 310 Preston Way, Lot 32 Raley Farms, Gulf Shores, Alabama and in OSHA inspection number 1726676, citation number 1, item number 3, and was affirmed as a final order on April 25, 2024, with respect to a workplace located at 12775 Philadelphia Boulevard, Franklin Place at independence, Foley, Alabama
