Other equivalent intermediate members (such as additional midrails and architectural panels) are installed so that the openings are not more than 19 inches (48 cm) wide.   On or about October 7, 2024, and at times prior, at an establishment located at 1236 North 18th Street in Sheboygan, Wisconsin, in the Old Pan Line department on the upper level platform on the Clearing Press 3371; the employer did not ensure there was an intermediate member installed on the ship stair landing so that openings were not more than 19 inches wide, exposing employees to a fall hazard of approximately 13 feet 8 inches to the concrete ground level.

The employer must ensure handrails are not less than 30 inches (76 cm) and not more than 38 inches (97 cm), as measured from the leading edge of the stair tread to the top surface of the handrail.   On or about October 7, 2024, to October 16, 2024, at an establishment located at 1236 North 18th Street in Sheboygan, Wisconsin, in the Old Pan Line department to the upper level platform on the Clearing Press 3371; the employer did not ensure the handrail on the left side ascending the ship stairs was not less than 30 inches and not more than 38 inches as measured from the leading edge of the stair treads to the top surface of the handrail, exposing employees to slip and fall hazards.

On or about October 7, 2024, to October 16, 2024, at an establishment located at 1236 North 18th Street in Sheboygan, Wisconsin, in the Old Pan Line department to the upper level platform on the Clearing Press 3371; the employer did not ensure the handrail on the left side ascending the ship stairs had 2.25 inches of clearance. The handrail was installed against a horizontal support beam and electrical conduit, exposing employees to slip and fall hazards.

29 CFR 1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.   On or about October 7, 2024, at an establishment located at 1236 North 18th Street in Sheboygan, Wisconsin, in the Old Pan Line department; the employer did not conduct an annual periodic inspection of the energy control procedure for Clearing Press 3371. Employees were exposed to machine hazards associated with the energized press and unexpected start-up or release of energy sources due to the lack of periodic inspections to identify any deviations or inadequacies in the procedure.
