29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about October 18, 2024, at a job site located at 10108 S Macintosh Ln, Oak Creek, WI 53154, the employer failed to ensure employees tasked with installing shingles and ridge vent on a 10/12 pitch roof were protected by guardrail systems, safety net systems, and/or personal fall arrest systems, exposing the employees to a fall hazard of approximately 12 feet in the front, on the first level of the house and 24.5 feet in the back of the house from the second level.  The Cardenas Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1748462, citation number 1, item number 1, and was affirmed as a final order on 7/24/2024, with respect to a workplace located at 1435 W Kimberly Avenue, Kimberly, WI 54136.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) On or about October 18, 2024, located at 10108 S Macintosh Ln, Oak Creek, WI 53154, the employer did not ensure the portable extension ladder used by employees to access the roof of the two-story residential home extended at least three (3) feet above the upper landing, exposing employees to a fall hazard of approximately 12 feet.  The Cardenas Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.1053(b)(1), which was contained in OSHA inspection number 1748462, citation number 1, item number 2, and was affirmed as a final order on 7/24/2024, with respect to a workplace located at 1435 W Kimberly Avenue, Kimberly, WI 54136.

(a) On or about October 18, 2024, located at 10108 S Macintosh Ln, Oak Creek, WI, 53154, the employer failed to verify fall protection training by preparing a written certification record for each employee engaged in roofing work.  The Cardenas Construction LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.503(b)(1), which was contained in OSHA inspection number 1748462, citation number 2, item number 1, and was affirmed as a final order on 7/24/2024, with respect to a workplace located at 252 Ponderosa Drive, Hartford, WI 53027.
