29 CFR  1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  (a)  Cardenas Construction LLC failed to certify abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 2, a serious violation of 29 CFR 1926.100(a) with an abatement date of May 27, 2025.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a)  Cardenas Construction LLC failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of June 3, 2025.    Citation 1, Item 3 a serious violation of 29 CFR 1926.503(c)(3) with an abatement date of June 3, 2025.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  (a) On or about April 10, 2025, the employer had not ensured frequent and regular inspections of the job site were conducted by a competent person to ensure hazardous conditions were found and corrected. Hazards identified, included but were not limited to; fall protection not being worn, fall protection anchor point not properly installed, and hardhats not used by employees working underneath overhead work.

29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.  (a) On or about April 10, 2025, employees performing clean up on the ground without a hard hat on, while other employees were installing shingles and throwing debris from the roof above, exposing the employees to a struck-by hazard.

29 CFR  1926.503(c)(3): When the employer has reason to believe that any affected employee who has already been trained does not  have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee.   (a)  On or about April 10, 2025, the employer did not ensure employees exposed to potential fall hazards had been properly trained to recognize and minimize the fall hazards associated with their work.  This is to include proper installation of anchor points, the proper selection of fall protection equipment and the proper use of the fall protection equipment.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about April 10, 2025, the employer had not ensured that employees performing clean up and shingle installation on the back side of the residential property were protected from falling to the lower level, exposing employees to a fall hazard of approximately 13 feet to the ground below.  (b) On or about April 10, 2025, the employer had not ensured that employees installing shingles on the lower garage roof were protected from falling to the lower level, exposing employees to a fall hazard of approximately 9 feet to the ground below.  Cardenas Construction LLC. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1748462, citation number 1, item number 1, and was affirmed as a final order on July 24, 2024, with respect to a workplace located at 252 Ponderosa Drive, Hartford, WI 53027.  Cardenas Construction LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1779638, citation number 1, item number 1 and was affirmed as a final order on November 4, 2024, with respect to a workplace located at 1261 Nature Trail Drive, Neenah, WI 54956.
