29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 8325 North Ridge Rd. Valley Center, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling TAMKO Heritage architectural asphalt shingles, Mule-Hide Products JTS 1 joint & termination sealant, Sascho Through the Roof elastomeric sealant and gasoline which can cause skin, eye and respiratory irritation, nausea and/or vomiting, drowsiness and/or dizziness, redness and/or swelling, itching and/or burning, may cause an allergic skin reaction, is suspected of causing cancer and may be fatal if swallowed and enters airways.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: (Construction Reference: 1926.59) At the job site located at 8325 North Ridge Rd. Valley Center, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided access to the Safety Data Sheets for TAMKO Heritage architectural asphalt shingles, Mule-Hide Products JTS 1 joint & termination sealant, Sascho Through the Roof elastomeric sealant and gasoline at the job site. These chemicals can cause skin, eye and respiratory irritation, nausea and/or vomiting, drowsiness and/or dizziness, redness and/or swelling, itching and/or burning, may cause an allergic skin reaction, is suspected of causing cancer and may be fatal if swallowed and enters airways.
