29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about October 21, 2024, on the west side of the project job site, employees working near a 36-meter concrete pump truck operating the boom within the slewing radius of overhead electrical power lines rated at 14.4KV's, without the required training to recognize the hazards in their industry.

29 CFR 1926.600(a)(6)(i): For lines rated 50kV or below, a minimum of 10 feet was not maintained between the energized line and the equipment. On October 21, 2024, and at times prior thereto, on the west side of the project, the employer was using a 36-meter concrete pump truck operated within 10 feet of an overhead electrical power line rated at 14.4KV's.

29 CFR 1926.600(a)(6)(iv): A person was not designated to observe clearance of the equipment and give timely warning for all operations where it is difficult for the operator to maintain the desired clearance by visual means: On or about October 21, 2024, on the west side of the project, the employer directed a concrete pour using a Schwing 36 meter concrete pump truck near an overhead electrical power line without using a spotter to maintain a safe operating distance.
