29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Arroyo's Exteriors LLC, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of January 2, 2025.  Citation 2, Item 2, a repeat-serious violation of 29 CFR 1926.503(a)(1) with an abatement date of January 2, 2025.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  (a) On or about October 30, 2024, the employer had not ensured frequent and regular inspections of the job site were conducted by a competent person to ensure hazardous conditions were found and corrected. Hazards identified included fall protection not being installed or utilized while working at heights of approximately 10 feet.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a) On or about October 30, 2024, employees conducting roofing work on an existing residential roof with a 4:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 10 feet to the ground below.  Arroyo's Exteriors LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1547185, citation number 1, item number 1 and was affirmed as a final order on October 4, 2021, with respect to a workplace located at 1909 Mallard Pointe Circle, Waukesha, WI 53189.  Arroyo's Exteriors LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1729520, citation number 2, item number 1 and was affirmed as a final order on July 25, 2024, with respect to a workplace located at 4654 S. Lake Road, Colgate, WI 53017.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) On or about October 30, 2024, the employer had not ensured that employees exposed to potential fall hazards had been trained to recognize and methods to minimize the fall hazards associated with their work. This exposed employees to a fall hazard of approximately 10 feet from the residential roof to the ground below.  Arroyo's Exteriors LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1729520, citation number 1, item number 2, and was affirmed as a final order on July 25, 2024, with respect to a workplace located at 4654 S. Lake Road, Colgate, WI 53017.
