29 CFR 1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103) a) On or about October 21 2024, KLG Contracting Inc at 1440 Amsterdam Avenue, New York, NY 10027 - Rooftop Employees performing concrete scarification on the rooftop were provided with respirators such as but not limited to 3M 8210 N-95 respirator and 3M 6200 elastomeric respirators for voluntary use. The employer did not provide respirator users with the information contained in Appendix D of this standard. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

29 CFR 1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user. a) On or about October 21, 2024, KLG Contracting Inc. located at 1440 Amsterdam Ave, New York, NY 10027 - Rooftop Employees performing concrete scarification on the rooftop were provided with respirators such as but not limited to 3M 8210 N-95 respirator and 3M 6200 elastomeric respirators for voluntary use. The employees were not medically evaluated to determine if they were medically able to use the respirator and they did not ensure that the respirator was cleaned and maintained so it does not create a hazard. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

29 CFR 1926.1153(i)(1):The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200). a) On or about October 21 2024, KLG Contracting Inc at 1440 Amsterdam Avenue, New York, NY 10027 - Rooftop Employees performing concrete scarification of the floor on the rooftop are exposed to the hazards of respirable crystalline silica (RCS). The hazards related to exposure to RCS was not included in the written hazard communication program. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
