29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: a) On or about November 6th, 2024 the employer J&S Stone, LLC DBA Northern OH Cut Stone LLC located at 16222 CR 34 Bellevue, Ohio 44811 did not ensure that employees employees working in the main shop performing cutting and grinding of stone posing the potential for exposure to respirable particulates were provided with information and training of the hazards associated with respirable particulates, training should cover the health hazards associated with exposure to respirable particulates, identify works tasks that could result in employees exposure to respirable particulates, and lastly the methods such as engineering controls implemented to protect the employees from exposure to respirable particulates.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. a) On or about November 6th, 2024 the employer J&S Stone, LLC DBA Northern OH Cut Stone LLC located at 16222 CR 34 Bellevue, Ohio 44811 the employer did not ensure that employees working in the main shop performing cutting and grinding of stone posing the potential for exposure to respirable particulates were provided with effective training on the hazards associated with exposure to respirable particulates, included but not limited to job tasks that could result in exposure and controls in workplace to limit employee exposure.

29 CFR 1910.1053(f)(2)(i): The employer did not establish and implement a written exposure control plan that included the elements in 29 CFR 1910.1053(f)(2)(i)(A)-(C): a)On or about November 6th, 2024 the employer J&S Stone, LLC DBA Northern OH Cut Stone LLC located at 16222 CR 34 Bellevue, Ohio 44811 had not developed a written exposure control plan for Crystalline Silica which included but not limited to the following: A description of the tasks in the workplace that involve exposure to respirable crystalline silica; a description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; and a description of the housekeeping measures used to limit employee exposure to respirable crystalline silica. Employees risk exposure to Crystalline Silica during work operations such as stone cutting, grinding, and/or facing.
