29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Nava Construction failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1 a serious violation of 29 CFR 1926.20(b)(2) with an abatement date of April 9, 2025.  Citation 1, Item 3 a serious violation of 29 CFR 1926.102(a)(1) with an abatement date of April 9, 2025.  Citation 1, Item 5 a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of April 23, 2025.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   (a) On or about November 6, 2024, the employer did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected. Hazards identified included, but were not limited to fall protection not installed and/or used properly, safety glasses, and ladders not extending three feet above the landing surface.

29 CFR 1926.100(a): At this job site, employees exposed to possible head injury from falling or flying objects or from impact with hand tools, equipment and building materials during construction operations were not wearing hard hats.  (a) On or about November 6, 2024, at the jobsite located at 321 Prospect Ave, Pewaukee WI 53072, the employer did not ensure that an employee was using head protection while working under personnel, materials, and equipment while cleaning up around the residential home, there by exposing the employee to struck by hazards.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about November 6, 2024, at the jobsite located at 321 Prospect Ave, Pewaukee WI 53072, the employer did not ensure employees installing shingles on a residential house and detached garage using a pneumatic nail gun used eye protection, exposing the employees to eye hazards from flying particles.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about November 6, 2024, at the jobsite located at 321 Prospect Ave, Pewaukee WI 53072, employees installing new shingles and on the existing residential house were not using fall protection. This exposed employees to fall hazard of approximately 9 feet.  (b) On or about November 6, 2024, at the jobsite located at 321 Prospect Ave, Pewaukee WI 53072, employees installing new shingles on the existing residential detached garage were not using fall protection. This exposed employees to fall hazard of approximately 9 2/10 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   (a) On or about November 6, 2024, at the jobsite located at 321 Prospect Ave, Pewaukee WI 53072, employees were accessing/egressing existing residential roof on the house from a ladder which did not extend three feet above the upper landing surface. This exposed employees to a fall hazard.  (b) On or about November 6, 2024, at the jobsite located at 321 Prospect Ave, Pewaukee WI 53072, employees were accessing/egressing existing residential roof on the detached garage from a ladder which did not extend three feet above the upper landing surface. This exposed employees to a fall hazard.
