29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section: a) On or about November 6, 2024, at 928 Peachtree Run, Magnolia, DE 19962, - The employees were exposed to the hazard at approximately 12 feet above grade, without fall protection. The owner and two employees were exposed to a fall hazard without wearing any personal arrest systems equipment. The Hershberger Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1596433.015, citation number 01001, item number 1 and was affirmed as a final order on 02/23/2023, with respect to a workplace located at 717 Ward Branch Road in Milford, DE.
