29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about November 07, 2024, the employer failed to ensure that employees performing roofing activities on an work area with unprotected sides and edges were utilizing a fall protection system. As a result, employees were exposed to a fall height of at least 9'0" on a 4/12 pitch roof.

29 CFR 1926.1053(b): Use. The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated: (1) When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) On or about November 07, 2024, the employer failed to ensure that the ladders being utilized by employees performing roofing activities to access the roof was extended 3 feet above the upper landing surface. As a result, employees were exposed to fall heights of at least 10'4".

29 CFR 1926.503(a)(2): Training program. The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: (i) The nature of fall hazards in the work area; (ii) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; (iii) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; (vi) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and (vii) The role of employees in fall protection plans; (viii) The standards contained in this subpart. a) On or about November 07, 2024, the employer failed to ensure that employees performing roofing work were trained as necessary on the: nature of fall hazards in the work area, correct procedures for inspecting the fall protection being used, use and operation of personal fall arrest systems, and standards contained in this subpart.
