29 CFR 1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. On or about November 12, 2024, at a job-site located at 1201 Graham RD, Stow Ohio 44224; the employer did not ensure employees were adequately protected from rolling and or falling debris from a spoil pile that was located directly at the edge of the East side of the trench. Employees were working in the 8.7 foot deep trench leveling and moving wet concrete directly below the loose material at the edge of the trench.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about November 12, 2024, at a job-site located at 1201 Graham RD, Stow Ohio 44224; the employer did not ensure adequate cave-in protection was used to protect an employee working inside a trench with near vertical side walls and a depth of approximately 8.7 feet. The trench was determined to have type "B" soil.
