An abatement demand letter was sent to the employer on August 8, 2025.

Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item, failure to comply will result in an additional penalty of $1,000.00 as per 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  Location: 114 Grand St, Croton on Hudson, NY 10520  a) On or about May 24, 2024, employees were exposed to fall hazards of approximately 20 feet while using an extension ladder to access the roof to perform roof work. The side rails of the ladder did not extend at least 3 feet above the roof surface.  Note: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.
