(a) On or about November 19, 2024, the employer did not ensure that the lockout/tagout procedures for the Baker #1 Upcut Saw addressed pneumatic energy which exposed employees to amputation and laceration hazards. (b) On or about November 19, 2024, the employer did not ensure that the lockout/tagout procedures for the Baker #2 Upcut Saw addressed pneumatic energy which exposed employees to amputation and laceration hazards.

29 CFR 1910.147(c)(6)(i):The employer did not conduct an annual or more frequent inspection of the energy control procedure to ensure that the procedure and requirements of this standard were followed: (a) On or about November 19, 2024, the employer did not ensure periodic inspections of their lockout/tagout program was completed to procedures were up to date and accurate. The procedures for the two Baker upcut saws did not address both energy sources of electrical and pneumatic energy within the procedures.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) On or about November 19, 2024, the employer did not ensure that the bottom of the saw blade for the Baker #1 Upcut Saw was properly guarded, in-that the access door was opened and not securely closed, exposing the saw operator an to amputation hazard. (b) On or about November 19, 2024, the employer did not ensure that the bottom of the saw blade for the Baker #2 Upcut Saw was properly guarded, in-that the side access door to the saw blade was open and did not have a means to securely close the side access door. Additionally, the access door was not sufficiently guarded in-that it had two holes in it (9" x 2' (upper) and 5 1/2" x 2" (lower)), exposing employees to an amputation hazard.
