29 CFR 1910.30(a)(1): The employer did not provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart before any employee is exposed to a fall hazard. And/or the employer did not ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. a. In the boat storage area: On or about November 19, 2024, employees were exposed fall hazards while doing maintenance and/or accessing boat storage racks while dismounting a forklift attached platform at heights approximately 30 feet, in that, training and education on fall protection was not provided. The employees were required to use fall protection but training on the limitations and proper use of fall protection was not provided.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval and the capacity, operation, and maintenance instruction plates, tags or decals of the powered industrial truck were not changed accordingly. a. In the boat storage area: On or about November 19, 2024, the employer exposed employees to struck-by and fall hazards in that a modified and unapproved platform attachment was used with the Wiggins 3.2 forklift, Model Number W3.2M2, without first ensuring that the attachment was secured to the forklift as to not allow for slippage. b. In the boat storage area: On or about November 19, 2024, the employer exposed employees to struck-by and fall hazards in that a modified and unapproved platform attachment was used with the Wiggins 4.3 forklift, Model Number W4.3M2, without first ensuring that the attachment was secured to the forklift as to not allow for slippage.
