29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Jobsite: On or about Saturday, November 23, 2024, eight employees were not protected from falling off of a residential roof while they were installing asphalt shingles on a residential house under construction. The pitch of the roof was about 4 in 12 and the fall hazard to employees ranged from approximately 10 to 24 feet to the ground.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section:Note: Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previous training obsolete; or (3) Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding and skill: (a) Jobsite: On or about Saturday, November 23, 2024, the employer needs to retrain its employees on when and how to use personal fall protection when working from a roof.
