29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data shall be in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer. a) On or about November 25, 2024, during an excavation of a water line at 2205 North Ave, Cleveland, Ohio 44134, the employer did not ensure employees setting the Vertical Aluminum Hydraulic Shoring jacks from tabulated data were in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer. Employees were exposed to a cave-in hazard from the trench with a depth of 5.8-feet.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a) On or about November 25, 2024, during an excavation of a water line at 2205 North Ave, Cleveland, Ohio 44134, the employer did not ensure employees working inside a trench, with a depth of five-foot (5'), and approximately 90 degree vertical walls, were protected from cave-ins by an adequately designed protection system. The soil was classified as; pre-disturbed, Type "B". b) On or about November 25, 2024, during an excavation of a water line at 2205 North Ave, Cleveland, Ohio 44134, the employer did not ensure employees working inside a trench, with a depth of 5.8-feet, and approximately 90 degree vertical walls, were protected from cave-ins by an adequately designed protection system. The soil was classified as; pre-disturbed, Type "B". Catts Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1500545, citation number 2, item number 1 and was affirmed as a final order on January 25, 2021, with respect to a workplace located at 5446 Hollywood, Maple Heights, Ohio 44137. Catts Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1466647, citation number 1 item number 1 and was affirmed as a final order on 3/27/20, with respect to a workplace located at Wildflower Drive, Rocky River, Ohio 44116.
