29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. At a worksite located at 2620 NE Woodland Oak Drive, Lees Summit, MO 64086, employees were exposed to struck by hazards to their face and eyes. The employer exposed the employees to these hazards by allowing them to utilize a pneumatic nail gun without the use of eye protection. Real Best Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1644222, citation number 1, item number 1 and was affirmed as a final order on 4/28/2023, with respect to a workplace located at 17420 Gillette St, Overland park, KS 66221.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): At a worksite located at 2620 NE Woodland Oak Drive, Lees Summit, MO 64086, employees were exposed to fall hazards. The employer exposed the employees to these hazards by allowing them to perform construction activities at heights greater than 6 feet without the use of fall protection. Instances of exposure include, but are not limited to: 1. One employee was observed performing framing activities at heights greater than 10 feet while working from the first level of the structure, near the southeast section. 2. One employee was observed performing framing activities at heights greater than 20 feet while working from the second level of the structure, near the southeast section. 3. One employee was observed performing framing activities at heights greater than 8 feet while working from plywood attached to the first level of the structure, near the northern area. 4. One employee was observed performing framing activities at heights greater than 10 feet while working from the first level of the structure, near the northwest section. Real Best Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1644287, citation number 1, item number 1 and was affirmed as a final order on 4/20/2023, with respect to a workplace located at 17420 Gillette St, Overland Park, KS 66221.
