OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushing hazards during caisson drilling operations: a) On or about December 2, 2024, Stalworth Underground, LLC employees were exposed to struck-by, crushing, and/or caught-between hazards during caisson drilling operations of the CA 1-A shaft while walking and working inside of the Danger Zone of the Soilmec SR-75 CCS Drill Rig, while the machine was in operation. b) On or about December 2, 2024, Stalworth Underground, LLC employees were exposed to struck-by, crushing, and/or caught-between hazards during caisson drilling operations of the CA 1-A shaft while walking and working within the swing radius of the Soilmec SR-75 CCS Drill Rig, while the machine was in operation. c) On or about December 2, 2024, Stalworth Underground, LLC employees were exposed to struck-by and crushing hazards during caisson drilling operations of the CA 1-A shaft where attachments for a Soilmec SR-75 CCS Drill Rig where not securely stored in areas where employees were working.

29 CFR 1926.501(b)(7)(ii): Each employee at the edge of a well, pit, shaft, or similar excavation 6 feet (1.8 m) or more in depth was not protected from falling by guardrail systems, fences, barricades, or covers: a) On or about December 2, 2024, employees performing caisson drilling operations were exposed to fall hazards of approximately 7 feet while working around an unprotected caisson shaft. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
