29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced.  a) On or about December 6, 2024, at Lot #2 Rojan Meadows and North Little Creek Road, Dover De 19901 - Employees were observed walking and working from an elevated platform of a construction telehandler that had been modified to be an unsupported makeshift platform at an elevation of over 24 feet from the ground.   The CS Contractor Corp.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.602(c)(1), which was contained in OSHA inspection number 1739168, citation number 01005, item number 5 and was affirmed as a final order on  8/29/2024, with respect to a workplace located at Jobsite located at or near Pietro Way and Palermo Drive, Philadelphia, PA 19145.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about December 6, 2024, at Lot#1 Rojan Meadows and North Lettle Creek Road, Dover De 19901- CSHO observed three employees walking and working on the west side of the residential structure without the use of fall protection.  Employees were observed standing on the timber framed structure at elevation of 12 feet without fall protection. The employees were in plain view of the competent person (Eddie Alves) and the superintendent of the project.  b) On or about December 6, 2024, at Lot#2 Rojan Meadows and North Lettle Creek Road- CSHO observed two employees walking and working on a timber framed residential structure from an elevated improvised platform without using any fall protection Employees were observed exposing themselves to fall hazards in the plain view of the competent person (Eddie Alves) and the site superintendent of Rojan Meadows without any corrected action by neither of them. employees were observed working at elevations of over 20' without fall protection.  The CS Contractor Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1736080, citation number 01001, item number 1 and was affirmed as a final order on 07/11/2024, with respect to a workplace located at 12 Washington Crossing Pennington Road, Pennington, NJ.
