29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.   a) On August 4, 2025, at Lot 91, Woodfield Development, Magnolia, DE 19962, the employer failed to provide fall protection retraining to employees exposed to fall hazards. Workers were performing framing activities at heights of approximately 12 feet without fall protection.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) On August 4,2025 at lot 91, Woodfield Development, Magnolia, DE 19962 - Employer did not instruct the employees in the avoidance of unsafe conditions and the need for eye protection while operating nail guns exposing them to eye-injuries.  The CS Contractor Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1722834, citation number 01, item number 2 and was affirmed as a final order on 8/29/2024, with respect to a workplace located at Pietro Way and Palermo Drive, Philadelphia, PA 19145 .

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun.   a) On August 4,2025 at lot 91, Woodfield Development, Magnolia, DE 19962 - CSHO observed an employee operating a nail gun without the use eye protection, exposing  the employee to eye-injuries, loss of an eye, blindness, infection or long-term damage.  The CS Contractor Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102 (A)(3), which was contained in OSHA inspection number1766201, citation number 01, item number 01 and was affirmed as a final order on 03/20/2025, with respect to a workplace located at 4031 Independence Dr., Schnecksville PA, 18078.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) On August 4, 2025 at lot 91, Woodfield Development, Magnolia, DE 19962 - CSHO observed four employees standing on the top of a wall  approximately 12-feet above grade without the use of fall protection which could lead to injuries resulting in permanent disability, fractures or even death.  The CS Contractor Corp was previously cited for a repeat violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1792105, citation number 1, item number  #2 and was affirmed as a final order on 06/18/2025, with respect to a workplace located at  Lot#1 Rojan Meadows and North Little Creek Road, Dover, DE 19901.  The CS Contractor Corp was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 29 CDR 1926.501(b)(13), which was contained in OSHA inspection number1768887, citation number 1, item number #1 and was affirmed as a final order on 03/12/2025 with respect to a workplace located at Lot #82 Castleberry Lane, Nobles Pond, Cheswold, DE 19934.
