OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards:  a.) On or about December 5, 2024, and at times prior thereto, located in the abrasive blasting booth, employees were exposed to a crushed-by hazard while performing abrasive blasting on metal sheets that were positioned in free-standing, shop-made fixtures with slots that allowed the metal sheets to lean.  b.) On or about December 6, 2024, and at times prior thereto, located in the main shop, employees were exposed to a crushed-by hazard while utilizing an overhead crane to move loads and the hoists open-throat hook was missing the safety latch.

29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition:  On or about December 5, 2024, and at times prior thereto, located in the abrasive blasting booth, the walking-working surface where employees perform blasting operations was not regularly inspected and maintained in a safe condition where blasting media collected under the floor resulting in uneven surfaces.

29 CFR 1910.22(a)(3): Walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice.  On or about December 5, 2024, and at times prior thereto, located in the blasting booth, employees performed blasting operations where the metal flooring had been torn resulting in sharp protruding metal pieces.
