29 CFR 1910.134(c)(2)(i): The employer did not determine if the voluntary use of a respirator would, in itself, not create a hazard: a) Allegany Solid Surfaces Technology, LLC dba ASST, 350 South Street, McSherrystown, PA 17344 - On or about December 10, 2024, the employer permitted employees, who were not medically evaluated, to voluntarily wear and utilize 3M 5200 half mask respirators. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: a) Allegany Solid Surfaces Technology, LLC dba ASST, 350 South Street, McSherrystown, PA 17344 - On December 10, 2024, the employer permitted employees to voluntarily wear 3M 5200 half mask respirators without establishing and implementing those elements of a written respiratory protection program necessary to ensure that any employees using the 3M 5200 half mask respirators voluntarily were medically able to use those respirators, and that the respirators were cleaned, stored, and maintained so that there use did not present a health hazard to the users. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
