29 CFR  1910.253(b)(2)(ii): Inside of buildings, cylinders shall be stored in a well-protected, well-ventilated, dry location, at least 20 (6.1 m) feet from highly combustible materials such as oil or excelsior. Cylinders should be stored in definitely assigned places away from elevators, stairs, or gangways. Assigned storage spaces shall be located where cylinders will not be knocked over or damaged by passing or falling objects, or subject to tampering by unauthorized persons. Cylinders shall not be kept in unventilated enclosures such as lockers and cupboards.  Engineering Shop: On/about December 13, 2024, two oxygen and two carbon dioxide gas cylinders were not well protected and could be subjected to being knocked over or damaged.  Employees were exposed to struck by and asphyxiation hazards.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  On/about December 13, 2024, two eye wash stations were not available for immediate use due to the water valve being shut off.  Employees were potentially exposed to corrosive chemicals in the following locations: a. Outside Chiller/Cooler Building: Employee use ChemTex 3560-OT (pH 11-14), ChemTex 6269 (pH 11-14), ChemTex 9160 (pH <1), and ChemTex AA-4215 (pH 1-4) to treat water.  b. Near Ice Maker, Main Kitchen: Employees use Betco Symplicity Sanibet Multi-Range (pH 6-9) to clean.  The Avi Resort & Casino was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.151(c), which was contained in OSHA inspection number 1560981, citation number 01, item number001 and was affirmed as a final order on 12/16/2021, with respect to a workplace located at 10000 Aha Macav Parkway in Laughlin, NV 89029.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:    Main Kitchen:  On/about December 13, 2024, employees voluntarily wore Lement KN95 particulate respirators and SunJoy K1 KN95 protective masks during cleaning tasks, and the employer did not provide the information in Appendix D of the Respiratory Protection Standard.

29 CFR 1910.157(c)(1): The employer shall provide portable fire extinguishers and shall mount, locate and identify them so that they are readily accessible to employees without subjecting the employees to possible injury.   Ground Weld Shop: On/before December 13, 2024, a Class A fire extinguisher was left unmounted on a workbench.  Employees were exposed to smoke and burn related injuries from the potential fire hazards if the fire extinguisher is not quickly accessible.

29 CFR 1910.1030(f)(2)(iv): The employer did not ensure that employees who declined to accept the hepatitis B vaccination offered by the employer signed the statement in appendix A:  On/about December 13, 2024, the employer did not ensure that the employee signed the declination statement when the employee declined the hepatitis B vaccination when first hired around July 2018.  The employer did not have the employee sign a statement of declination until December 17, 2024.
