29 CFR 1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. (a) Abel Construction failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected: Citation 1, Item 2 a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of June 6, 2025. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about December 17, 2024, employees conducting roofing work on a new residential property with a 5:12 pitch roof, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 18 1/2 feet over the residential property.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) On or about December 17, 2024, the employer did not ensure employees exposed to potential fall hazards had been properly trained to recognize and minimize the fall hazards associated with their work, and how to properly install anchor points and ensure proper selection of fall protection equipment.
