29 CFR  1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance.  a. On or about December 20, 2024, an employee was exposed to pinch point hazards when conducting maintenance and servicing work on a Danley 150 Ton OBI mechanical power press, Machine #939. The employer did not ensure that the documented energy control procedures included rules and techniques for employees to utilize when re-energizing the press to perform diagnostic testing and/or inspection of the press components after performing die-setting activities, such as adjusting the dies.

29 CFR  1910.147(f)(1): Testing or positioning of machines, equipment or components thereof. In situations in which lockout or tagout devices must be temporarily removed from the energy isolating device and the machine or equipment energized to test or position the machine, equipment or component thereof, the following sequence of actions shall be followed:   29 CFR  1910.147(f)(1)(ii): Remove employees from the machine or equipment area in accordance with paragraph (e)(2) of this section.   a.  On or about December 20, 2024, an employee was exposed to pinch point hazards when performing testing and/or positioning of the Danley 150 Ton OBI mechanical power press, Machine #939, after performing a die adjustment. The employer did not ensure that the employee was clear from the hazardous area(s) of the press prior to operating the machine.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a. On or about December 20, 2024, an employee was exposed to a pinch point between the kiss post and the ram while operating the Danley 150 Ton OBI mechanical power press, Machine #939.

29 CFR  1910.217(d)(9)(i): The employer did not establish a diesetting procedure for mechanical power press(es) that would ensure compliance with 29 CFR 1910.217(b)-(c).  a. On or about December 20, 2024, an employee was exposed to pinch point hazards while performing die-setting activities on a Danley 150 Ton OBI mechanical power press labeled as Machine #939. The employer did not implement die setting procedures that ensured the point of operation was safeguarded while barrier guards are removed. No alternative means of protection was provided while the employee was reaching in and around the dies to perform die adjustments.

29 CFR  1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a. On or about December 20, 2024, the employer did not ensure employees performing servicing and maintenance activities on mechanical power presses were effectively trained on procedures necessary to provide effective employee protection during diagnostic testing, positioning and/or inspection of press components to ensure that employees are not exposed to hazards associated with moving parts.
