29 CFR  1926.501(b)(14):Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  Location: 136 Passaic Ave. Livingston, NJ 07039.  a: The employer failed to ensure employees working near wall openings were protected from fall hazards. Two employees were exposed to fall hazards at 10 feet and 20 feet respectively while hoisting down construction materials from an elevator shaft without any means of fall protection.   Violation occurred on or about January 3, 2025.   Benitez Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1596762, citation number 1, item number 1 and was affirmed as a final order on July 20, 2022, with respect to a workplace located at 199 Texas Rd. Old Bridge, NJ 08857.
