29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Residential construction located on Lot #157 Kongoni Court, Cumming, GA 30041, Top Plate: On or about 01/04/2025, the employer exposed employees to fall hazards of up to 21-feet, 10-inches to the lower ground level, in that a fall protection system was not provided to employees installing ceiling joists using the top plate as a walking/working surface engaged in framing activities.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) Residential construction located on Lot #157 Kongoni Court, Cumming, Georgia 30041, Ground floor to top plate: On or about 01/04/2025, the employer failed to extend the ladder 3 feet past the landing of the next walking/working surface while engaged in framing activities.
