29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about January 11, 2025, at the Northeast corner of Knollwood Blvd, Magnolia, De 19962 - CSHO observed two employees walking and working on a timber framed residential structure without fall protection. Employees were observed performing construction operations near the edge of the roof without fall protection measures used. The Pablo Rocael Enriquez Perez dba White Star Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1726650, citation number 01002, item number 2 and was affirmed as a final order on 3/15/2024, with respect to a workplace located at Lot 107 Vessel Dr., Middletown, DE 19709 . The Pablo Rocael Enriquez Perez dba White Star Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13), which was contained in OSHA inspection number 1726719, citation number 01002, item number 2 and was affirmed as a final order on 3/15/2024, with respect to a workplace located at 332 E Green Street, Middletown, DE 19709: On or about February 7, 2024.

In no case shall the original safety factor of the equipment be reduced. a) On or about January 11, 2025, at the Northeast corner of Knollwood Blvd, Magnolia, De 19962 - Employees were observed walking and working from an elevated platform of a construction telehandler that had been modified to be an unsupported makeshift platform at an elevation of over 14 feet from the ground.
