1910.178(l)(4)(ii)(A) Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required after an operator was observed to operate the vehicle in an unsafe manner to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. a) 290 Emig Road EMIGSVILLE, PA 17318 - a material handling employee was operating a Yale sit down powered industrial truck without utilizing a seatbelt, on or about January 15, 2025. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service. a) 290 Emig Road EMIGSVILLE, PA 17318 - Employees were exposed to electrical hazards while conducting metal fabrication operations due to a damaged flexible power cord attached to a Continental Dynamics floor fan (Model 42-5559), located across from the paint booth, on or about January 15, 2025. Abatement certification required within 15 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
