29 CFR 1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: a) Worksite was located at 425 2nd Avenue, Spring Lake, NJ 07762 A worker was exposed to fall hazards of approximately two-stories to ground as they stood on a wooden pallet being used as a scaffold platform while working. The platform was being supported by a Gradall 534C Material Handler. The pallet was not secured to the machine. Violation was observed on or about January 14, 2025 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Worksite was located at 425 2nd Avenue, Spring Lake, NJ 07762 A worker was exposed to fall hazards of approximately twelve feet to ground as they worked from the second floor deck while not utilizing fall protection. Violation was observed on or about January 15, 2025 The FS Alvarado Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1598796 , citation number 1, item number 1 and was affirmed as a final order on 03/29/2023, with respect to a workplace located at 17 Washington St, Spring Lake, NJ 07762. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
