Except as provided in paragraphs (a)(2), (a)(3), (a)(4), (a)(5) and (g) of this section, each scaffold and scaffold component shall be capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it. On or about January 16, 2025, at 5509 Vern Holmes Drive in Stevens Point, Wisconsin, employees were exposed to a fall hazard while climbing up and walking on the inside edge of a scissor lift mid-guardrail to use the guardrail as a work platform. The guardrail was not designed to be a walking working surface.

Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide. On or about January 16, 2025, at 5509 Vern Holmes Drive in Stevens Point, Wisconsin, employees were exposed to a fall hazard working from a 0.5-inch wide, mid-rail of a scissor lift guardrail system that was not designed as a working surface.

29 CFR 1926.451(g)(1)(vii): Scaffolds. Fall Protection. Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about January 16, 2025, at 5509 Vern Holmes Drive in Stevens Point, Wisconsin, employees were exposed to a fall hazard working from a scissor lift's mid-guardrail 10 ft. 4 in. above surface level without using required fall protection equipment.

29 CFR 1926.454(a)(3): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the proper use of the scaffold, and the proper handling of materials on the scaffold. On or about January 16, 2025, at 5509 Vern Holmes Drive in Stevens Point, Wisconsin, the employer did not provide required scaffold safety training for employees exposed to fall hazards while using a scissor lift.
