29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   At the worksite located at 2818 North Oak Avenue: Employees are exposed to noise hazards. Noise levels exceed an 8-hour time-weighted average sound level of 85 decibels on the A scale, and the employer has not implemented and administered a hearing conservation program. This was shown in instances:  a.) Employee James Eden was exposed to 88.2 dBA over a period of 469 minutes. b.) Employee Derek Gillette was exposed to 90.6 dBA over a period of 427 minutes.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  At the worksite located at 2818 North Oak Avenue Springfield MO: Employees were exposed to chemical, debris, and noise hazards. The employer did not assess the workplace for hazards, nor conduct job hazard analyses, to determine if the use of PPE is necessary during business tasks and operations, such as but not limited to safety glasses during grinding work, appropriate gloves when dispensing and using chemicals, and exposure to noise and airborne aluminum.

29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  At the worksite located at 2818 North Oak Grove Avenue: Employees were exposed to respiratory hazards. Employees voluntarily use N95 respirators and a full face respirator without a written respiratory protection program established and implemented for the worksite. When a respiratory protection program is established for voluntary use for respirators other than dust masks, a written program must be established and include:  1. Provisions for medical evaluation of employees.  2. Establishing and adhering to schedules for cleaning, disinfecting, storing, inspecting, repairing, removing from service or discarding, and otherwise maintaining respirators.
