OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to struck-by and crushed-by hazards: a) On January 23, 2025, and at times prior thereto, employees operated the Hyster 90 FORTIS H90XM with S/N: N005V02423E forklift which was not equipped with an operator restraint device such as a seatbelt.
