29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing safety hazards): (a) Roof, Lot #8-1, 474 Stage Coach Boulevard, Kimberly, AL: On or about January 23, 2025, the employer exposed employees to safety hazards in construction, in that he did not develop a safety program and provide a competent person to conduct frequent and regular inspections of jobsites, materials, and employees while they conducted roof shingle installation activities on a new single family residential home, with pneumatic nail guns, while working on a 6/12 pitch roof at heights 6 feet and greater to the ground below without fall protection and eye protection. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation. (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET)

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Roof, Lot #8-1, 474 Stage Coach Boulevard, Kimberly, AL: On or about January 23, 2025, the employer exposed employees to safety hazards in construction, in that he did not instruct his employees in the recognition and avoidance of unsafe conditions in their work environment, such as but not limited to, fall hazards in construction 6 feet or greater to the ground below and struck-by hazards while they conducted shingle installation activities, operating pneumatic nail guns, while working on a 6/12 pitch roof at heights 6 feet or greater to the ground below without fall protection and eye protection. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation. (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET)
