29 CFR 1926.21(b)(2): Employer responsibility. The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about January 27, 2025, the employer failed to instruct employees utilizing a pulley system attachment on a forklift of the hazards of working under raised forks. As a result, employees were exposed to a struck-by hazard.

29 CFR 1910.178(l)(3): Safe operation. Training program content. Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace. (i) Truck-related topics: (A) Operating instructions, warnings, and precautions for the types of truck the operator will be authorized to operate; (M) Any other operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate. a) On or about January 27, 2025, the employer failed to ensure that employees operating the JLG G5-18A Lull Forklift (S/N: GTD46J0008548M) were trained on precautions to be taken prior to working near the powered industrial vehicle. As a result, employees were exposed to struck-by hazards.
