29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: Employees engaged in grain receiving and cleaning activities voluntarily using half-face respirators were exposed to respiratory hazards in that the information contained in Appendix D was not provided. If a respirator is used improperly or not kept clean, the respirator itself can become a hazard to the worker. Therefore, it is necessary to take certain precautions to be sure that the respirator itself does not present a hazard.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: In the grain receiving area, employees performing grain handling activities, and voluntarily using respirators were exposed to health hazards associated with wearing Moldex, and 3M half mask elastomeric respirators, in that employees utilizing respirators to prevent excessive dust exposure were not medically evaluated to determine if it was safe for employees to utilize
