29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) Excavation, located at 3449 Winder Hwy. Flowery Branch, GA 30542: On or about 01/29/2025, the employer exposed employees to respiratory hazards due to silica exposure from using a Stihl TS 420 14-inch cut-off saw to dry cut a concrete precast manhole without any engineering controls, work practices, or respiratory protection as described in Table-1.

Flowery Branch, GA 30542; On or about 01/29/2025, and at times prior, the employer did not assess all employees who may be exposed to silica health hazards through monitoring to ensure they are not over exposed.
