29 CFR 1910.1053(j)(3)(i): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of the health hazards associated with exposure to respirable crystalline silica; specific tasks in the workplace that could result in exposure to respirable crystalline silica; specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica; the contents of this section; and the purpose and a description of the medical surveillance program required by paragraph (i) of this section: On or about 02/04/2025, employees conducting concrete mixing activities, truck washout activities as well as concrete grinding activities at a jobsite located at 8934 Woodend Road in Kansas City, Kansas, were exposed to inhalation hazards and health hazards as result of exposure to silica in that employees were not trained on the hazards posed by silica containing materials such as Portland cement, sand, and precast that they use everyday.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area: On or about 02/04/2025, employees at a jobsite located at 8934 Woodend Road in Kansas City, Kansas had not been provided effective information and training to recognize, evaluate, and control exposure to hazardous chemicals including but not limited to; diesel, muriatic acid, and coolants. Diesel exposes employees to flammability hazards as well as asphyxiation hazards, muriatic acid is a corrosive and category 1 irritant, and Polar Long Life 50/50 Prediluted Antifreeze & Coolant is categorized as toxic to humans and an irritant.
