29 CFR  1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  On or about February 10, 2025, a continuing, effective hearing conservation program, including audiograms, noise monitoring, and training, was not implemented in the workplace to determine if employee exposure exceeded the 8-hour time-weighted average of 85 decibels.   a) On February 10, 2025, an employee working in the middle of the Supervac line was exposed to noise at 155.2% of the permissible daily dose, or an average sound level of 93.6 dB, as measured over 448 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 93.1 dB accounting for the 32 minutes unmonitored. This employee has been an employee for approximately 2 years and 3 months and never received an audiogram.  b) On February 10, 2025, an employee working on the Cryovac Line next to the cryovac machine was exposed to noise at 170% of the permissible daily dose, or an average sound level of 94.3 dB, as measured over 449 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of  93.8 dB accounting for the 31 minutes unmonitored. This employee has been an employee for approximately 3 years and never received an audiogram.  c) On February 10, 2025, an employee working on the Rollstock line next to the Ultra Sonic Cutter Machine was exposed to noise at 164.9% of the permissible daily dose, or an average sound level of 94.1 dB, as measured over 447 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 93.6 dB accounting for the 33 minutes unmonitored. This employee has been an employee for approximately 1 year and never received an audiogram.   d) On February 10, 2025, an employee working on the Rollstock line was exposed to noise at 173.7% of the permissible daily dose, or an average sound level of 94.4 dB, as measured over 450 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 93.9 dB accounting for the 30 minutes unmonitored. This employee has been an employee for approximately 3 years and never received an audiogram.   e) On February 10, 2025, an employee working on the Cryovac Line next the Ultra Sonic Cutter Machine was exposed to noise at 147.1% of the permissible daily dose, or an average sound level of 93.3 dB, as measured over 443 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 92.7 dB for the 37 minutes unmonitored. This employee has been an employee for approximately 1.5 years and never received an audiogram.

29 CFR  1910.95(i)(2)(i): The employer did not ensure that hearing protectors are worn by an employee who is required by 29 CFR 1910.95(b)(1) to wear personal protective equipment:   On or about February 10, 2025, hearing protectors were not worn by the employee who had not yet had a baseline audiogram established for instances such as, but not limited to:  a) On February 10, 2025, an employee working on the Supervac Line was exposed to noise at 154.2% of the permissible daily dose, or an average sound level of 93.6 dB, as measured over 448 minutes of monitoring. This dose is equivalent to an 8-hour TWA exposure of 93.1 dB accounting for the period of 32 minutes unmonitored.  b) On February 10, 2025, an employee working on the Cryovac Line next to the cryovac machine was exposed to noise at 169.8% of the permissible daily dose, or an average sound level of 94.2 dB, as measured over 449 minutes of monitoring. This dose is equivalent to an 8-hour TWA exposure of 193.8 dB accounting for the period of 31 minutes unmonitored.   c) On February 10, 2025, an employee working on Rollstock line next to the Ultra Sonic Cutter was exposed to noise at 164.2% of the permissible daily dose, or an average sound level of 94 dB, as measured over 447 minutes of monitoring. This dose is equivalent to an 8-hour TWA exposure of 93.5 dB accounting for the period of 33 minutes unmonitored.  d) On February 10, 2025, an employee working on the Rollstock in the middle of the line was exposed to noise at 172.8% of the permissible daily dose, or an average sound level of 94.4 dB, as measured over 450 minutes of monitoring. This dose is equivalent to an 8-hour TWA exposure of 93.9 dB accounting for the period of 30 minutes unmonitored.  e) On February 10, 2025, an employee working on the Cryovac Line was exposed to noise at 146.5% of the permissible daily dose, or an average sound level of 93.3 dB, as measured over 443 minutes of monitoring. This dose is equivalent to an 8-hour TWA exposure of 92.7 dB accounting for the period of 37 minutes unmonitored.
