29 CFR 1910.23(d)(13)(ii): The employer did not ensure that fixed ladders that do not have cages or wells have a minimum perpendicular distance of 30 inches (76 cm) from the centerline of the steps or rungs to the nearest object on the climbing side. Or, when unavoidable obstructions are encountered, a minimum clearance at the obstruction of 24 inches (61 cm), provided deflector plates are installed. On or about February 24, 2025, and at times prior, located on condensing tower EC-3 South, employees use a fixed ladder where the climbing space contains piping within 30 inches of the perpendicular centerline when monitoring and maintaining the condition of the evaporative condenser.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices. On or about February 24, 2025, and at times prior, located in the North engine room, the employer did not document that the machinery room complied with the employer's chosen RAGAGEP, IIAR 2 (2014) Standard for Safe Design of Closed Circuit Ammonia Refrigeration Systems, Sections 6.2.1 and 6.2.5 when the machinery room allowed for the passage of air to an area that employees routinely occupy.
