29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  Location: Worksite  On or about February 26, 2025, employees were exposed to fall hazards of over 20 feet as well as struck- by hazards while performing framing and siding activities, where the employer did not ensure that a competent person made frequent and regular inspections of the site.

29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  Location: Worksite  On or about February 26, 2025, employees were exposed to struck-by hazards while performing framing and siding activities, where the employer did not ensure that employees were using protective helmets. No protective helmets were available on site.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun.  Location: Worksite  On or about February 26, 2025, employees were exposed to struck-by hazards from flying debris while performing framing and siding activities where the employer did not ensure that employees used impact resistant eye protection while working on site and operating pneumatic nail guns, saws, and other tools. No impact resistant eye protection was available on site.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  Location: Worksite  a) While standing and working on the makeshift wooden platform with fall hazards of over 20 feet.  b) While balancing, carrying, and installing fascia boards with fall hazards of over 20 feet.  c) While using the unguarded window as the point of access to and from the makeshift wooden platform with fall hazards of over 20 feet.  On or about February 26, 2025, employees were exposed to fall hazards of over 20 feet while performing framing and siding activities, where the employer did not ensure that fall protection was in place, by any means.  a) OSHA previously issued a citation alleging a Serious violation of this occupational safety and health standard or equivalent standard, 29 CFR 1926.501(b)(1) which was contained in OSHA inspection number 1408423, citation number 1, item number 1 and was affirmed as a final order on 8/22/2019 to the employer, with respect to a workplace located at 1950 Washington St., Boston, MA 02119 .
