29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   A written HAZCOM program was not developed for employees required to work with hazardous chemicals such as Golden Bay Eco Shore Portland Cement, which was a component of the cement mixture used to build masonry walls.  Employees were exposed to chemical hazards.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s):  Copies of the Safety Data Sheets (SDS) were not kept on site for hazardous chemicals to include Golden Bay Portland Cement that was in use at the jobsite. Employees were exposed to chemical hazards.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  Where Golden Bay Eco Shore Portland cement powder was used in a mixture, mixed in the onsite concrete mixer, employees were not trained as the hazards of the chemicals they were working with.  Employees were exposed to chemical hazards.

29 CFR  1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  Tafuna High School, ROTC Building, 2nd story: Employees were not provided with adequate hand protection while applying cement containing 90% Portland Cement to build a masonry wall.  Employees were exposed to chemical burn hazards.
