29 CFR  1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer:  a.  At 8130 Archibald Terrace, Jacksonville Florida 32219: On or about March 4, 2025 and times prior, an employee was required to wear a NIOSH approved, 3M Brand, N95 filtering facepiece dust mask respirator when installing siding for new construction homes and the employer did not implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluation, fit testing, and training on the use, maintenance and care of the respirator.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  a. At 8130 Archibald Terrace lot 94, Jacksonville Florida: On or about March 4, 2025 and times prior, the employer exposed an employee to respiratory hazards, in that the employer required the use of a 3M Brand, N95 filtering facepiece dustmask respirator to be worn while installing siding on new construction homes without first providing a medical evaluation to determine if the employee was able to wear a respirator or not.

At 8130 Archibald Terrace,  lot 94 Jacksonville Florida: On or about March 4,  2025 and times prior, the employer exposed an employee to respiratory hazards, in that the employer required the use of a 3M Brand, N95 filtering facepiece dustmask respirator and the employee had not been fit tested prior to initial use of the respirator.
