29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section. The employer failed to provide certification of abatement for the citation related to not wearing a harness and connecting device while working from an aerial lift, that was issued on March 20, 2025.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On or about March 06, 2025, at an establishment located at 2198 South Memorial Drive in Appleton, Wisconsin, employees were using an aerial lift to demolish a chimney and were not connected by lanyard and body harness to the aerial lift while performing the work.
