29 CFR  1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The employer failed to provide certification of abatement for the citations related to not implementing engineering controls and work practices specified on Table 1, assessing employee exposure to respirable crystalline silica, and developing and implementing a written silica exposure control plan, that were issued on March 20, 2025.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) On or about March 6, 2025, at the worksite located at 2198 South Memorial Drive, Appleton, Wisconsin; the employer did not ensure that employees fully and properly implemented the engineering controls and work practices specified on Table 1 when employees were removing mortar containing crystalline silica with powered chipping tools (Bosch 11255VSR), exposing an employee to the hazards associated with respirable crystalline silica.

29 CFR  1926.1153(g)(1): The employer shall establish and implement a written exposure control plan that contains at least the following elements: (i) A description of the tasks in the workplace that involve exposure to respirable crystalline silica; (ii) A description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; (iii) A description of the housekeeping measures used to limit employee exposure to respirable crystalline silica; and (iv) A description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure, including exposures generated by other employers or sole proprietors.  a) On or about March 6, 2025, at the worksite located at 2198 South Memorial Drive, Appleton, Wisconsin; the employer did not establish and implement a written silica exposure control plan for when employees were removing mortar containing crystalline silica with powered chipping tools (Bosch 11255VSR), exposing employees to the hazards associated with respirable crystalline silica.
