29 CFR  1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: Note:  If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented.  (a) Top of framed walls - On or about March 7, 2025 the employer instructed his employees to work from the top of the framed walls greater than 11 feet high without any type of fall safety system exposing employees to fall hazards.

29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a) Front of building - On or about March 7, 2025, the employer had employees use the 6 foot step ladder to gain access to the top of the first floor framed walls that was not tall enough to extend 3 feet above the top plate edge and no other supports were used to gain access exposing employees to fall hazards.
