29 CFR 1910.147(c)(2)(ii): If an energy isolating device is capable of being locked out, the employer's energy control program under paragraph (c)(1) of this section shall utilize lockout, unless the employer can demonstrate that the utilization of a tagout system will provide full employee protection as set forth in paragraph (c)(3) of this section. a. On or about March 11, 2025, on the converting line 2, RoAn Sideweld Solid 9500, the employer failed to ensure that employees performing servicing and/or maintenance activities such as, but not limited to roll changes, cleaning sealing knives, and unjamming, utilized lockout on energy isolating devices capable of being locked out. The employer's tagout system did not comply with paragraph (c)(1) of this section and did not provide full employee protection. b. On or about March 11, 2025, on the converting line 3, RoAn Sideweld Solid 9500, the employer failed to ensure that employees performing servicing and/or maintenance activities such as, but not limited to roll changes, cleaning sealing knives, and unjamming, utilized lockout on energy isolating devices capable of being locked out. The employer's tagout system did not comply with paragraph (c)(1) of this section and did not provide full employee protection.

29 CFR 1910.147(c)(3)(i): When a tagout device is used on an energy isolating device which is capable of being locked out, the tagout device shall be attached at the same location that the lockout device would have been attached, and the employer shall demonstrate that the tagout program will provide a level of safety equivalent to that obtained by using a lockout program. a. On or about March 11, 2025, in the converting department, the employer failed to ensure that tagout devices used on an energy isolating devices, capable of being locked out, were attached at the same location that the lockout device would have been. On the converting line 2, RoAn Sideweld Solid 9500, employees performing servicing and/or maintenance activities such as, but not limited to roll changes, cleaning sealing knives, and unjamming, did not attach tagout devices at the same location that lockouts device would have been attached. Additional safety measures were not used in conjunction with tagging of energy isolation devices to prevent unexpected re-energization such as, but not limited to, removal of valve handle or removal of an additional isolating circuit element-fuse, to provide a second layer of protection in the event the tagout device for the primary isolation was defeated. b. On or about March 11, 2025, in the converting department, the employer failed to ensure that tagout devices used on an energy isolating devices, capable of being locked out, were attached at the same location that the lockout device would have been. On the converting line 3, RoAn Sideweld Solid 9500, employees performing servicing and/or maintenance activities such as, but not limited to roll changes, cleaning sealing knives, and unjamming, did not attach tagout devices at the same location that lockouts device would have been attached. On or about March 11, 2025, the specific procedures for hazardous energy control (lockout/tagout) of the RoAn Sideweld Solid 9500 bag machines did not include: [1910.147(c)(4)(ii)(B)] Specific procedural steps for shutting down, isolating, blocking, and securing bag machines to control all applicable electrical, hydraulic, pneumatic, and thermal hazardous energy sources; [1910.147(c)(4)(ii)(C)] Specific procedural steps for the placement and removal tagout devices; [1910.147(c)(4)(ii)(D)] Specific procedural steps for testing the machine or equipment to determine and verify the effectiveness of tagout devices and other energy control measures, thereby exposing employees to struck-by, caught in, and thermal hazards associated with performing servicing and/or maintenance activities.

29 CFR 1910.147(c)(5)(ii)(C)(2):Tagout devices. Tagout devices, including their means of attachment, shall be substantial enough to prevent inadvertent or accidental removal. Tagout device attachment means shall be of a non-reusable type, attachable by hand, self-locking, and non-releasable with a minimum unlocking strength of no less than 50 pounds and having the general design and basic characteristics of being at least equivalent to a one-piece, all environment-tolerant nylon cable tie. a. On or about March 11, 2025, on the converting line 3, the employer failed to ensure that tagout devices and their means of attachment were substantial enough to prevent inadvertent or accidental removal. Employees performing servicing activities to the RoAn Sideweld Solid 9500 bag machine applied tags using a magnetic clip. The tagout devices were not self-locking, non-releasable with a minimum unlocking strength of no less than 50 pounds as a tagout device, thereby exposing employees to potential hazardous energy release during servicing activities.

The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards. b. On or about March 11, 2025, an employee was exposed to struck-by, caught in, and thermal hazards associated with performing servicing and/or maintenance activities such as but not limited to roll changes, sealing knife cleaning and unjamming of the converting line 3, RoAn Sideweld Solid 9500.
